Speeding Tickets - Avoid Prosecution for your Speeding Offence

The Word of One Person is not sufficient for a Speeding Offence Prosecution

"A person prosecuted for a speeding offence shall not be liable to be convicted on the evidence of one witness to the effect that, in the opinion of the witness, the person prosecuted was driving the vehicle at a speed exceeding a specific limit"* – S. 89 (2) Road Traffic Regulation Act 1984.

The word of one person is not sufficient for a speeding ticket prosecution. There must be at least two witnesses who say that a vehicle was speeding; if the opinion of one witness is the only evidence and no speed camera was used, even if the witness is a police officer.*

The severity of the punishment for a speeding offence depends on the speed that you are accused of travelling at. If you are caught speeding on a regular road you will receive between three and six penalty points and a fine of up to £1000. If you are travelling at 30mph or more over the speed limit you will most likely be disqualified and banned from driving.

If you are convicted of a motorway speeding offence, you will receive between three and six penalty points on your licence and a fine of up to £2500. If you are caught speeding in excess of 100mph you will most likely receive a driving disqualification unless good mitigation is presented.

In order to be prosecuted for speeding, you must be warned of Prosecution by Notice of Intended Prosecution (a speeding ticket) or verbally.

If you are caught speeding and stopped by the police you must receive a fixed penalty notice speeding ticket or a verbal notice of intended prosecution on the grounds of speeding.

If you are not stopped you must be warned of prosecution for speeding within 14 days usually by issue of a section 172 notice. Thereafter, you must respond to the notice for your speeding offence within 28 days.
