Taxi Drivers


Under the Local Government (Miscellaneous Provisions) Act 1976 anybody wishing to operate as a Hackney or private hire driver must be deemed a fit and proper person before being granted with a licence. You must also meet certain criteria to run a taxi business. Each local authority must produce its own guidance in relation to the regulation of taxi licences. This guidance forms the basis of their determination of every application.

The local authority has strict codes in relation to whether a licence holder is a fit and proper person. Anybody with previous convictions or other examples of poor conduct may have their application suspended or refused. This can be very stressful where taxi driving is your livelihood and only source of income. There is a right of appeal against the decision of the local authority. If you are convicted of a minor road traffic offence you will have to declare it to the local authority and this may lead to a review of your licence. Local authorities are very strict on private hire taxis operating outside the terms of their licence. Taxis can only pick up pre booked fares and picking up off the street or plying for hire can lead to prosecution and disqualification from driving. Ensure this does not happen to you.
