Adrian Palmer recently represented Mr B before Vale Royal Magistrates Court in Northwich, Cheshire. Mr B was summonsed in relation to a number of offences including driving a motor vehicle without due care and attention and driving a vehicle in dangerous condition. Following pleas of guilty, penalty points were endorsed upon the defendant’s licence which resulted in him totting up to 14 points and being liable for a minimum 6 month period of disqualification under the totting up provisions. Cunninghams Solicitors liaised with Mr B’s employers and arranged for a representative of the firm to attend Court to provide evidence that his employment would be terminated should he face a period of disqualification of any length. The Magistrates concluded that exceptional hardship existed in this case and the defendant was allowed to continue to drive, albeit with 14 points on his licence.
