			<content:encoded><![CDATA[<p>Paul recently represented Mr M at Manchester City Magistrates Court.  Mr M had been summonsed to Court for an offence of driving without a valid certificate of motor insurance.  Mr M had been driving for less than 2 years and was at risk of having his licence revoked, as the minimum sentence for the offence is 6 penalty points.  Mr M ran a trial by way of special reasons.  The Magistrates found special reasons and Mr M was given an absolute discharge and was therefore able to keep his driving licence.</p>

			<content:encoded><![CDATA[<p>Everybody knows that <a href="http://www.drivingoffencesolicitor.co.uk/nature-of-offence/insurance-offences/"><strong>driving with no insurance</strong></a> is against the law, yet that isn&#8217;t enough to stop an estimated one million people in the UK from failing to properly insure their vehicle. However, not all drivers who drive uninsured are intentionally breaking the law. Sometimes, drivers simply misunderstand the type of cover they require and mistakenly take out an unsuitable insurance policy.</p>
<p>Also, many people believe that they have a ‘grace period’ in which to renew their recently expired insurance policy, only to find out that they don’t. Of course, there are always drivers around who choose to intentionally break the law in the hope that it will save them some money.</p>
<p>Whether intentional or not, any driver who gets caught driving without insurance can receive a fine of up to £5000 and 6 to 8 penalty points on their driving licence. It is even possible to face a <a href="http://www.drivingoffencesolicitor.co.uk/nature-of-offence/driving-ban-appeals/"><strong>driving ban</strong></a> in some cases. Police now also have the power to perform spot checks and so can issue fixed, on-the-spot penalty fines. These immediate penalties entail a fine of £200 and six penalty points on the offending motorist’s license.</p>
<p>With the police now able to confiscate and destroy any vehicle which turns out to be uninsured, and with convictions of uninsured <a href="http://www.drivingoffencesolicitor.co.uk/"><strong>motoring offences</strong></a> rising every year, it simply doesn’t pay to drive without insurance.</p>

			<content:encoded><![CDATA[<p>Cunninghams have recently been acted for Mr S in relation to proceedings before Wakefield Magistrates Court, Yorkshire.  Mr S was charged with failing to stop at the scene of an accident, driving with no insurance and driving whilst disqualified.  The case was made more serious as Mr S was originally arrested whilst driving a works van.  He admitted to the police that he had worked for that company for a number of years, the obvious inference being that he had been driving whilst disqualified for a number of years.  Powerful mitigation was put forward in relation to Mr S’s personal circumstances and the Court imposed a very lenient sentence of 100 hours of unpaid work in the community with no separate penalty for either of the offences of no insurance or failing to stop at the scene of an accident.  Mr S was particularly relieved with the outcome as it seemed almost inevitable that he could receive a short custodial sentence.</p>

			<content:encoded><![CDATA[<p>Carl Millar recently represented Mr J at Liverpool Magistrates Court in relation to an allegation of <a title="Insurance Offences" href="http://www.drivingoffencesolicitor.co.uk/nature-of-offence/insurance-offences/" target="_self">driving without a valid certificate of insurance</a>.</p>
<p>The facts of the case became quite complicated. Mr J entered a not guilty plea as he was of the view that the trade policy in force covered him as an employee of the company that he worked for. However, there was some ambiguity as Mr J was the registered keeper of the vehicle and the vehicle was now owned by the company. Mr J was advised that there would be a defence to his case, in any event, by virtue of Section 143(3) of the Road Traffic Act 1988. Section 143(3) provides a special defence for employees using vehicles in the course of their employment in ignorance of the lack of cover. The burden of proof is on the defendant to show on the balance of probabilities that he thought that a valid certificate of insurance was in place.</p>
<p>In Mr J’s case, the insurance company did confirm that they would indemnify Mr J in the event of an accident and therefore the prosecution decided to discontinue the case against Mr J.</p>

			<content:encoded><![CDATA[<p>Tom recently acted on behalf of Mr I in relation to an allegation of driving without insurance before Bromley Magistrates Court.  Regrettably, Mr I had only limited funds and, therefore, rather than representing the defendant in Court Tom entered into negotiation with the Crown Prosecution Service in advance of the trial.  Ultimately, Tom managed to persuade the Crown Prosecution Service to discontinue all charges against Mr I without the matter ever having need for a Court hearing.  This dramatically reduced the fees that Mr I had to pay and, as a consequence of the matter being discontinued, the defendant was entitled to a defendants’ costs order which will result in a full or partial reimbursement of his fees.</p>

Tom was able to enter into negotiation with the Crown on Mr H’s behalf as he was unable to pay for our services to represent him in Court.  For a much reduced fee, we were able to persuade the Crown to discontinue the case against Mr H without the matter ever being called before the Court.  A defendants’ costs order was awarded which will entitle Mr H to a full or partial reimbursement of the fees paid.</p>
