			<content:encoded><![CDATA[<p>Carl recently represented Miss H who appeared before Bury Magistrates Court, Greater Manchester in respect of allegations of <a href="http://www.drivingoffencesolicitor.co.uk/nature-of-offence/dangerous-careless-driving/">dangerous driving</a>, <a href="http://www.drivingoffencesolicitor.co.uk/nature-of-offence/failure-to-stop-and-report-an-accident/">failing to stop</a> and <a href="http://www.drivingoffencesolicitor.co.uk/nature-of-offence/drink-driving-offences/driving-with-excess-alcohol/">driving with excess alcohol</a>.</p>
<p>Regrettably, Miss H had a very high breath reading, which was in excess of 120ųg in 100ml of breath.  The starting point for any reading at this level would automatically attract a custodial sentence as a starting point.  To compound matters, Miss H had driven into 5 stationary vehicles without stopping and caused in excess of £15,000 worth of damage.  Obviously, with such a high breath reading and an aggravating feature of <a href="http://www.drivingoffencesolicitor.co.uk/nature-of-offence/failure-to-stop-and-report-an-accident/">failing to stop</a> after driving into a number of vehicles, there was a very real possibility that a custodial sentence would be imposed and indeed, this was indicated by the Magistrates at the first hearing and Miss H was ordered to see the Probation Service for the preparation of a pre-sentence report.</p>
<p>In cases such as these, if the Magistrates are considering sentencing a defendant to a period in custody, the preparation of a pre-sentence report is required by the Probation Service who will meet with the defendant and make recommendations to the Magistrates.</p>
<p>At the sentence hearing, Carl presented powerful mitigation on Miss H’s behalf to try and persuade the Magistrates not to impose an immediate prison sentence and to consider instead imposing a suspended sentence.  The report from the Probation Service also agreed with Carl’s view that a prison sentence would have a negative impact due to Miss H’s vulnerability and she would be at risk of exploitation by other inmates.  The devastating impact a custodial sentence would have on her family was also a factor as Miss H is a single mother with highly dependent children.</p>
<p>The Magistrates were persuaded by Carl’s representations and decided to suspend the custodial sentence.  Obviously, Miss H was delighted with the outcome as she genuinely feared that she would be going to prison.</p>

Representations were made to the prosecutor at Court on the trial date.  Paul successfully persuaded the prosecutor to discontinue proceedings against Mr Y.  The Court granted an application for a defendants’ costs order, which will mean that the defendant will be entitled to a partial or full refund of his fees.</p>

			<content:encoded><![CDATA[<p>Cunninghams have recently been acted for Mr S in relation to proceedings before Wakefield Magistrates Court, Yorkshire.  Mr S was charged with failing to stop at the scene of an accident, driving with no insurance and driving whilst disqualified.  The case was made more serious as Mr S was originally arrested whilst driving a works van.  He admitted to the police that he had worked for that company for a number of years, the obvious inference being that he had been driving whilst disqualified for a number of years.  Powerful mitigation was put forward in relation to Mr S’s personal circumstances and the Court imposed a very lenient sentence of 100 hours of unpaid work in the community with no separate penalty for either of the offences of no insurance or failing to stop at the scene of an accident.  Mr S was particularly relieved with the outcome as it seemed almost inevitable that he could receive a short custodial sentence.</p>

			<content:encoded><![CDATA[<p>Carl Millar recently represented Mr D at Trafford Magistrates Court in Manchester, in relation to an allegation of failing to stop at the scene of an accident, failing to report an accident and careless driving.  Mr D was a “new driver”( a new driver is governed by the Road Traffic (new drivers) Act 1995 which establishes a 2 year probationary period for newly qualified drivers and applies to any person who first passes a driving test on or after its commencement date, which was on June 1st 1997.  The accumulation of 6 or more penalty points by such a driver before the end of the period of 2 years beginning on the date on which he first passed the driving test will result in the revocation of his licence and the requirement for him to pass another driving test in order to restore his previous entitlement),  and therefore faced revocation of his licence if he accumulated 6 penalty points or more within the probationary period, which is 2 years from the date of passing your driving test.</p>
<p>Failing to stop at the scene of an accident carries between 5-10 endorsable penalty points.  Likewise, failing to report an accident carries between 5-10 endorsable penalty points.  Careless driving carries between 3-9 penalty points.  Mr D was very concerned that his licence would be revoked and requested that Carl Millar try to persuade the Court to give him a short period of disqualification instead of his licence being revoked.  </p>
<p>If somebody’s licence is revoked then they will need to arrange for a driving test once again which will involve applying for a provisional licence and being subject to the terms of a provisional licence, before having to pass both the theory and practical driving tests before they are in a position to be able to drive.  Also, the penalty points will remain on the licence.  All three aforementioned offences carry a discretionary period of disqualification. </p>
<p>In Mr D’s case, Carl Millar was able to persuade the Magistrates at Trafford Magistrates Court to disqualify Mr D for a very short period, instead of his licence being revoked.  This has the advantage of the defendant not having to take his tests again, and he will have a clean licence once the period of disqualification has expired.</p>

			<content:encoded><![CDATA[<p>Cunninghams Driving Defence Solicitors represented Mr M who was charged with offences of driving with excess alcohol, failing to stop at the scene of an accident and driving without due care and attention.  Mr M entered a guilty plea at Bexley Magistrates Court in Kent and the case was adjourned as the Magistrates were giving serious consideration to imposing a custodial sentence.  Following a lengthy plea and mitigation the Magistrates chose to impose a short period of community service and a small financial penalty rather than sending Mr M to prison.  He was also disqualified from driving for a period of 20 months, which would be reduced by 5 months upon successful completion of the drink drivers’ rehabilitation course.</p>
