We were instructed by Ms S, who was disqualified from driving for a period of six months under the totting up procedure at Weymouth Magistrates Court. At the time, Ms S represented herself. Paul was instructed by Ms S to appeal against the decision to the Crown Court. In the interim period prior to the Crown Court hearing being fixed, an application to suspend the disqualification was made. The appeal took place at Bournemouth Crown Court, which was ultimately successful and therefore Ms S was able to retain her driving licence, despite having 12 penalty points endorsed on it.

Mr G had been disqualified from driving for a period of 28 months for an offence of drink driving. His reading was 83 in breath. Mr G, from Salisbury, Wiltshire, contacted us over a year after his conviction for advice on appeal. Tom successfully persuaded the Court to allow Mr G leave to appeal out of time. His disqualification period was reduced to 13 months, entitling Mr G to commence driving immediately. A defendants’ costs order was awarded entitling Mr G to full reimbursement of his fees paid.
