Minimum Sentence for Driver in Telford 16/10/2012

Paul was recently instructed by Mr W who had been summonsed to appear before Telford Magistrates Court, Shropshire, in respect of an allegation of failing to stop following an accident.  An incident had occurred on the M50 motorway whilst Mr W was driving home from work.

Mr W pleaded guilty to the offence and wished for his mitigation to be advanced to the Court.  The Court heard from the prosecutor who referred to a statement from the other driver involved in the incident.  Paul advanced strong and compellable mitigation on behalf of Mr W.  After hearing the evidence from both the prosecution and the defence, the Magistrates were persuaded by the mitigation advanced on Mr W’s behalf and found his version to be credible.  Having sympathy for Mr W, the Court imposed the minimum sentence possible, which is 5 penalty points.  Mr W was delighted with the outcome and had been very apprehensive at the prospect of appearing before the Magistrates.  As Mr W was represented by Paul on this occasion, he got the result he was looking for without the worry of having to present his own case.
