Disqualification Avoided in Bury, Manchester 17/02/2012

Paul was instructed by Miss P who was summonsed to Bury Magistrates Court in Greater Manchester for allegations of failing to stop and failing to report an accident.

Having considered the evidence and obtaining Miss P’s instructions, Paul advised Miss P that it may be possible to persuade the Crown Prosecution Service to discontinue one of the allegations against her.  Paul made powerful representations to the Crown Prosecution Service who ultimately agreed to discontinue the allegation of failing to report an accident against Miss P.  Miss P had intended to plead guilty to the failing to stop offence, but was at risk of a disqualification under the totting up procedure as she already had 6 points on her licence.  If the Court imposed anything above the minimum of 5 points for the offence, then Miss P was at risk of a disqualification for six months under the totting up procedure for accumulating 12 points within a 3 year period.

At the hearing at Bury Magistrates Court, strong mitigation was advanced on behalf of Miss P and the Court in Bury, Greater Manchester, imposed the minimum sentence of 5 penalty points, which resulted in Miss P being able to keep her driving licence and continue driving.
