Paul recently represented Mr B at Walsall Magistrates Court, West Midlands. Mr B was charged with driving with excess alcohol. This was his third drink driving offence within a 15 year period, and his second within 10 years. A second drink driving offence within a 10 year period automatically attracts a minimum period of disqualification of 3 years, but there was an aggravating factor in that this was Mr B’s third drink driving offence, coupled with the fact that he was also found to be in possession of cocaine. The Magistrates could use these aggravating features to impose a harsher sentence but Paul advanced strong mitigation on behalf of Mr B and successfully persuaded the Magistrates to sentence him to the minimum period of disqualification of 3 years. Mr B was very pleased with the result.
