Carl recently represented Mr S at Hammersmith Magistrates Court in London in relation to an allegation of driving with excess alcohol. Mr S had a very high reading, which was at 112ug in 100ml of breath. Mr S was very concerned about receiving a custodial sentence and he was also concerned about the practicalities of him actually being able to do a community penalty. The Magistrates Court Guidelines suggest a period of disqualification of between 23-28 months and the starting point at that level of reading is a medium level community penalty. After lots of persuasion, Carl was able to persuade the District Judge not to impose a community penalty on the defendant and, instead, he received a straightforward disqualification without having to serve a community penalty.
