What is “Driving whilst Disqualified?” 22/12/2010

There are lots of motoring offences that can lead to a driver being disqualified, such as driving with no insurance or convictions for drink driving. With this in mind, if you are driving whilst disqualified then the chances are that you have already committed a serious prior defence.

Therefore, not only are you at risk of serious prosecution if caught, but are directly endangering the public. Either way the ramifications will be very serious.

You might think that the chances of being caught whilst driving disqualified are small, however they are actually fairly high. Remember, the police are allowed to stop anyone that they want, and even if they do not suspect that you are committing an offence, it is still in their power to stop your vehicle.

The manner in which police stop vehicles isn’t arbitrary, and they use the latest in technology to check whether a registered vehicle has been involved in an offence. Specifically, they use the Automatic Vehicle Registration Recognition System (AVRRS,) which can immediately check whether the owner of the vehicle has committed an offence – thereby giving the police grounds to stop the vehicle.

Due to the seriousness of the driving offence, you will be arrested and your vehicle impounded (note that driving whilst disqualified could also mean that you lose your vehicle as well as your licence). The chances are the penalty for your crime will be very serious, and involve a custodial sentence or at least a hefty fine or community service order.
