Mr R had accumulated 12 penalty points over a period of 3 years and therefore faced being disqualified under the totting up procedure. The magistrates were persuaded not to disqualify Mr R as they accepted that his business would suffer unduly which may result in redundancies to his employees. Mr R was the “face of the company” and it was essential to the companies well-being that he had the ability to drive his vehicle as his skills were instrumental in courting new customers and winning new business. Thankfully, the Magistrates were persuaded to accept the submissions presented by Carl Millar.
