Charged with Drink Driving – reduced period of disqualification 25/03/2010

Tom recently acted on behalf of Ms B who was charged with an offence of drink driving and appeared before Scarborough Magistrates Court, Yorkshire. Ms B’s reading in breath was 111 which is a particularly high reading and could be given rise to a period of disqualification of between 23 and 28 months and a high level community order. Ms B’s credit for a guilty plea was diminished massively due to her only entering a guilty plea days before her trial was due to take place. Following detailed and powerful mitigation being advanced in Court, Ms B was sentenced to an 18 month period of disqualification and only sentenced to a low level community order. This was a particularly pleasing result for the defendant as the period of disqualification was lower than the recommended guidelines despite the fact she had pleaded guilty at the door of the Court.
