Cunninghams Driving Defence Solicitors recently represented Mr B who was charged with an offence of driving with excess alcohol. The level of alcohol in his breath was 49. Mr B was intending to plead guilty to the offence and could have expected to have been disqualified from driving for 12 months. On attending the first appearance at City of Westminster Magistrates Court in London, the prosecution had not brought a complete file of papers to Court. The case adjourned and 7 days later the prosecution had forgotten their file of papers completely! A successful application was made to the Court and the case was dismissed. Mr B was awarded a defendants costs order entitling him to a partial reimbursement of his fees.
