Mr G was charged with failing to furnish information and driving without due care and attention. Tom was able to persuade the prosecution to drop the allegation of failing to furnish information as the central ticket office had sent the notice to the wrong address. On the day of trial at Oldham Magistrates Court in Manchester, the prosecution were forced to drop the driving without due care matter as, following arguments, it was clear that the prosecution could not provide any evidence that Mr G was driving the vehicle. A defendants’ costs order was made entitling Mr G to a full reimbursement of fees.
